* Delwar wants to reopen Tazreen Fashions:

Tazreen Fashions Limited owner Delwar Hossain on Thursday said that he was planning to reopen the apparel factory at Ashulia, which was gutted on November 24, 2012 in a fire that killed at least 112 workers, mostly women.

Delwar, also the Tuba Group managing director, while talking to New Age after the Dhaka District and Sessions Judge’s Court on Thursday charged him, his wife Mahmuda Akter and 11 other Tazreen staff with murder, culpable homicide and killing by negligence for the fire at the factory on November 24, 2012.
He said that the court would pronounce verdict and judge whether he was guilty of the charges examining evidences and witnesses.
‘I am not thinking over the case because I know that I have committed no crime rather I have lost my business and property in the accidental fire…Now I am trying to survive with the business,’ he said.

Delwer said that he had a plan to start work in November or December to reopen Tazreen Fashions Ltd and engineers had already visited the building.

A Dhaka court yesterday framed charges against 13 people, including two owners of Tazreen Fashions, in a case over a devastating fire in the garment factory that killed 112 workers nearly three years ago.

The District and Sessions Judge’s Court fixed October 1 for starting the trial in the country’s worst industrial fire on November 24, 2012.

Tazreen’s Managing Director Delwar Hossain, his wife Mahmuda Akter, also chairman of the company, and six others — all on bail — claimed innocence and submitted separate petitions seeking discharge from the case.

Judge SM Kuddus Zaman rejected all the eight petitions. The other five accused were shown fugitives.

Tazreen Fashions managing director Delwar Hossain, his wife Mahmuda Akter and 11 other staff of the apparel factory were charged on Thursday with murder, culpable homicide and killing by negligence for the fire at the factory that killed at least 112 workers in 2012.

Dhaka district and sessions judge SM Kuddus Zaman also posted for October 1 the commencement of the trial with the recording of testimonies of prosecution witnesses.

The court also ordered the transfer of the case documents to the First Additional District and Sessions Judge’s Court for next proceedings of trial.
As the court read out the charges, eight accused – Delwar, Tazreen Fashions chairman Mahmuda Akter, manager (admin) Dulal Uddin, engineer M Mahbubul Morshed, store in-charges Md Hamidul Islam and Al Amin and security in-charges Al Amin and Anisur Rahman – pleaded not guilty to the charges and prayed for justice.
They are on bail.

A Dhaka court on Thursday indicted managing director and chairperson of Tazreen Fashions for the 2012 fire that killed more than one hundred workers of the apparel maker.

The court of Dhaka’s District and Sessions Judge M Kuddus Zaman framed the charges against the company’s managing director Delwar Hossain, its chairperson Mahmuda Akter and 11 others and set Oct 1 for recording witnesses’ testimonies.

At least 111 people died and more than 104 were injured in the fire at Tazreen Fashions at Ashulia in Savar on Nov 24, 2012.

In December 2013, police submitted a charge-sheet in the case over the incident, holding the 13 responsible for the tragedy. The accused had been charged with manslaughter and culpable negligence under Section 304 and 304 (a) of the Criminal Procedure Code, reports bdnews24.com.

A Dhaka court has framed charges against 13 people in two cases filed over the deadly fire at the factory of Tazreen Fashions, including its owner Delwar Hossain and his wife Mahmuda Aktar.

Dhaka District and Sessions Judge SM Kuddus Zaman framed the charges after rejecting he discharge petition filed by the accused on Thursday afternoon.
The court fixed October 1 for recording deposition of witnesses of the fire incident.

After framing charges, the court sent the case documents to First Additional District and Sessions Judge Court for trial.

The other accused are Engineer Mahbubul Morshed, Production Manager Mobarak Hossain Manju, Factory Manager Abdur Razzak, Quality Manager Shahiduzzaman, Manager (admin) Dulal Uddin, Store in-Charges Hamidul Islam and Al Amin, Security In-Charges Al Amin and Anisur Rahman, guard Rana and loader Shamim Miah.

The incident, the worst industrial fire in the country’s history, happened on November 24, 2012, killing at least 112 workers and injuring scores of others.

The District and Sessions Court Judge’s Court on Thursday deferred to September 3 the hearing in framing of charges against Tazreen Fashions managing director Delwar Hossain and 12 others in two cases for a fire at the apparel factory at Ashulia.

The judge of the court, SM Quddus Zaman deferred the hearing for the second time following a prosecution plea that they were not prepared for the hearing on petitions filed on the day by the defence counsel for discharging the accused from the cases.
On June 16, the court took cognisance of the charge sheet submitted against the 13 – Delwar, his wife Mahmuda Aktar, also the Tazreen chairman, and Tazreen Fashions officials and staff Dulal Uddin, Hamidul Islam, Al Amin-1, Anisur Rahman, Rana, Al Amin-2, Shamim Miah, Mahbubul Morshed, Mobarak Hossain Manju, Abdur Razzak and Shahiduzzaman.
The last four accused are still in hiding while the others are on bail.

A Dhaka court on Wednesday deferred to August 13 the hearing in the framing of charges against Tazreen Fashions managing director Delwar Hossain and 12 others for the fire at the apparel factory at Ashulia that killed at least 112 workers on November 24, 2012.

Dhaka district and sessions judge SM Quddus Zaman passed the order after defence counsels sought time for the hearing saying they lacked preparation and their senior counsel was busy in two other sensitive cases.

Public prosecutor Khandaker Abdul Mannan also told the court that he needed time to scrutinise large volume of documents of the case.

Rights activists decried delay in the trial as they gathered on the court premises demanding a quick disposal of the case.
Earlier on June 16, the court posted for Wednesday the hearing taking cognisance of the charge sheet.

Police filed a case with Ashulia police station on November 25, 2012 accusing 15 staff of negligence leading to murders.

Another case was filed against Delwar and 30 others on May 29, 2013 with Dhaka Chief Judicial Magistrate’s Court by Abdul Matin, brother of missing victim Rehana.
Later, the two cases merged into one.

The framing of charges in the case over the death of more than 100 workers in Tazreen Fashions Factory fire has been deferred.

Dhaka’s District and Sessions Judge M Kuddus Zaman granted a defence plea seeking time on Wednesday and fixed Aug 13 for the charge-framing.

One of the defence lawyers, Abu Bakar Farhad, filed the petition seeking time saying his colleague was busy with another case and would not be able to attend hearing.

At least 111 workers died and 104 injured in the devastating fire at the Tuba Group’s factory in Savar on Nov 24, 2012.

A case was filed against Tazreen Fashions Managing Director Delwar Hossain and his wife Mahmuda Akter Mita, the chairperson of the firm, and several other officials.

Tazreen Fashions fire accident victims are likely to get the fair amounts of compensation money before the third anniversary of the incident which took place in November 2012.

C&A Foundation has started working to develop a distribution methodology and measure compensation amounts.

In a deal with global union IndustriALL and Clean Clothes Campaign (CCC), the Foundation announced its commitment to make a significant contribution to ensure the workers got fair amounts of compensation, said a source.

* Initiative starts to compensate Tazreen victims:

The families of Tazreen Fashions fire victims might receive compensation as per the International Labour Organisation standards before the third anniversary of the tragic incident as the C&A Foundation, an affiliate of Dutch retailer C&A, has started its work to develop a distribution methodology.

On the second anniversary of Tazreen Fashions fire tragedy, the C&A Foundation had pledged to contribute a significant amount towards full and fair compensation for those injured in the fire and the families of the dead in a deal with global union IndustriALL and the garment workers’ pressure group Clean Clothes Campaign.

As per the agreement, the compensation amount will be determined based on the system already developed for the Rana Plaza victims.

Charge-framing hearing to start July 8

A court here on Tuesday accepted the chargesheet against 13 people, including Tazreen Fashions Managing Director and owner Delwar Hossain, in a case filed over the devastating fire in the garment factory that claimed over 100 lives in 2012.

Taking cognisance of the chargesheet, Judge of the District and Session’s Court SM Kuddus Jaman also fixed July 8 for staring charge-framing hearing against the 13 accused.

Eight of the accused, now on bail, were present at the court during the hearing on Tuesday while another detained accused was also produced.

The rest four –- factory engineer M Mahbubul Morshed, its manager Abdur Razzak, quality manager Shahiduzzaman Dulal and production manager Mobarok Hossain Manju — remained absconding.

At least 112 people were killed and over 200 others suffered injuries in the devastating fire that raged through the Tazreen Fashions at Nischintapur in Ashulia on the outskirts of capital Dhaka on November 24, 2012.

According to the charge sheet, Delwar and Mahmuda constructed the building following a faulty plan with the help of the accused engineer and illegally used the ground-floor walkway as a warehouse.

There was no fire exit in the factory, although a provision of the labour law stipulates that there must be two exits in every factory.

The factory was built a mile away from the main road, making it very difficult for fire service vehicles to enter the factory compound.

A court in Dhaka on Sunday asked Criminal Investigation Department to carry out further investigation in one of two cases filed over the Tazreen Fashions fire incident in 2012.

Dhaka’s Senior Judicial Magistrate Kazi Shahidul Islam passed the order after accepting an application filed by Matikul Islam, brother of a female RMG worker who died in the incident that killed over 112.

The court also asked CID to submit the investigation report before the court, in the case, on April 22. On May 29, 2013, RMG worker Rehena Akhter’s brother Matikul Islam filed a murder case against Delwar Hossain, owner of the Tazreen Fashions Ltd, and some unnamed other people.

The plaintiff mentioned in the case statement that the main accused Delwar had ordered that fire be set to the garment factory. further alleged that Delwar had hid Rehena’ dead body.

* Court directs CID to probe disappearance of worker:

A Dhaka court yesterday directed the Criminal Investigation Department for further investigation into the disappearance of a garment worker in the Tazreen Fashions fire in November 2012.

Rehena Begum, who worked at the finishing section of Tazreen Fashions Ltd, has been missing since the fire on November 24.

Senior Judicial Magistrate Kazi Shahidul Islam passed the order after Rehena’s brother Abdul Matin filed a no-confidence petition against the police report in this connection.

The court also asked CID’s Senior Assistant Superintendent of Police Monsur Ali Mondol to submit a probe report to it by April 22.
On September 23 last year, Md Azharul Islam Sarkar, officer-in-charge of Ashulia Police Station, submitted a probe report without any investigation into the matter.
On May 29 of 2013, Abdul Matin sued the owner of Tazreen Fashions, Delwar Hossain, and 30 others for their gross negligence which resulted in the death of his sister.
After the fire, Matin searched for his sister but did not find his sister or her body.

A Dhaka court yesterday asked Criminal Investigation Department to conduct further investigations in a case filed over the Tazreen Fashions fire incident in 2012, and submit the report by April 22.

Dhaka Senior Judicial Magistrate Kazi Shahidul Islam passed the order, granting the prosecution’s no-confidence petition filed against the final investigation report submitted by CID that found the allegations against the defendants were not true.

On May 29, 2013, a person named Matinul Islam had filed a murder case with the chief judicial magistrate’s court against the owner of the Tazreen Fashions Ltd, Delwer Hossain, and some unnamed people.
The complainant alleged that the main accused Delwer had intended to burn the factory. The resulting fire killed 117 people.

Relatives of garment workers who died in the Rana Plaza collapse and Tazreen Fashions fire and the injured workers formed a human chain beside the Dhaka-Aricha highway at Savar bus stand yesterday, demanding compensation.

The demonstrators formed the human chain under the banners “Rana Plaza Garment Workers’ Union” and “Tazreen Fashions Garment Workers’ Union”.

Nasima Akter, a victim of Tazreen Fashions fire, said it has been over two years since the fire occurred but she is yet to be compensated.

“We cannot pay for food much less other necessities after losing our source of income,” she said breaking down in tears.

She added that they are living inhuman lives.

Jorina Akter, president of Tazreen Fashions Garment Workers’ Union and a victim herself, said the victims need compensation immediately.

“Families of those who died are living very miserable lives after losing their breadwinners, and those who were injured cannot work anymore,” she said.
